1. General provisions
1.1. These Terms of Service (the "Terms") govern the relationship between Физическое лицо — предприниматель Асеев Александр Юрьевич (ФОП Асєєв Олександр Юрійович) (the "Administration") and the internet user (the "User") regarding the use of the online service ApexFlow, available at apexvision.trade (the "Service").
1.2. The Terms are an integral part of the Public Offer. By starting to use the Service (including authorizing via Google), the User confirms that they have read the Terms, the Privacy Policy and the Risk Disclaimer and accept them without reservation.
1.3. The Service is intended for persons aged 18 and over. By using the Service, the User confirms their full legal capacity.
2. Registration and sign-in via Google
2.1. Access to the Service is granted after authorization via a Google account (Google OAuth 2.0). During authorization the Service receives basic profile data from Google: email address, name and avatar. The Google account password is not transmitted to or stored by the Service.
2.2. One Google account corresponds to one Account. Creating multiple accounts by one person in order to obtain the trial period repeatedly or to bypass limits is prohibited.
2.3. The User must use a valid Google account belonging to them personally. Sharing access to the Account with third parties, or selling, renting or jointly using the account, is not allowed.
3. How to use the Service
3.1. The Service allows the User to:
- upload chart screenshots of financial instruments for automated analysis;
- receive analytical reports: market phase, scenarios, indicative levels;
- ask the AI assistant ALBERT questions about a specific analysis;
- view the history of their analyses;
- purchase token packages to run analyses.
3.2. The User undertakes to upload only images of financial-instrument charts. Uploading images that contain third-party personal data or materials that violate the law, intellectual-property rights or public morality is prohibited.
3.3. Analysis results are provided "as is", are intended for the User's personal, non-commercial use and may not be resold or systematically distributed without the Administration's written consent.
4. Acceptable use
When using the Service, it is prohibited to:
- take actions aimed at disrupting the normal operation of the Service, its servers and infrastructure;
- use automated tools (bots, scrapers, scripts) to access the Service, send bulk requests or harvest data;
- decompile, disassemble or reverse engineer the source code, algorithms and models of the Service, or create derivative products based on them;
- circumvent the Service's technical limits, including token, trial-period and access-control limits;
- present the Service's materials as individual investment advice when distributing them, or use the ApexFlow brand without the Administration's permission;
- use the Service for activity that breaches the law of Ukraine or the User's country of residence.
4.1. If breaches are detected, the Administration may restrict, suspend or terminate the User's access to the Service without refunding used tokens and, in cases provided for by law, pass information to the competent authorities.
5. Account security
5.1. Sign-in security is provided by Google OAuth mechanisms. The User must keep their Google account secure: use a strong password and two-factor authentication, and not share sign-in data with third parties.
5.2. All actions performed in the Service after authorization via the User's Google account are deemed performed by the User.
5.3. If the User suspects unauthorized access to their Account, they must immediately report it to sanya.aseev.88@gmail.com and take measures to protect their Google account.
6. Intellectual property
6.1. The ApexFlow / Apex Vision brands, the ALBERT AI assistant, the interface, source code, analysis algorithms, texts and other Service materials belong to Физическое лицо — предприниматель Асеев Александр Юрьевич (ФОП Асєєв Олександр Юрійович) and are subject to the Administration's exclusive rights.
6.2. The User receives only a limited, non-transferable, non-exclusive right to access the Service for its intended purpose within the scope of paid access. Ownership rights to the Service, its components and materials are not transferred to the User.
6.3. Copying, reselling, decompiling or disassembling the Service and its components, and creating derivative products based on them without the Administration's written consent, are prohibited.
7. User responsibility
7.1. The User is solely responsible for: the content of uploaded images; the security of access to their account; the compliance of their use of the Service with the laws of their jurisdiction; and all trading and investment decisions made with the help of the Service's materials and their financial consequences.
7.2. The User undertakes to compensate the Administration for losses caused by a breach of these Terms, in the manner provided by the law of Ukraine.
8. Amendment and termination of the Terms
8.1. The Administration is entitled to amend the Terms unilaterally. A new version takes effect when published at apexvision.trade/terms. Continued use of the Service constitutes agreement with the changes.
8.2. The User may stop using the Service at any time and request account deletion in the manner described in the Privacy Policy.
9. Final provisions
9.1. These Terms are governed by the law of Ukraine. Disputes are resolved in the manner set out in Section 11 of the Public Offer.
