1. Status of the Service
1.1. The online service ApexFlow (apexvision.trade), operated by Физическое лицо — предприниматель Асеев Александр Юрьевич (ФОП Асєєв Олександр Юрійович), is a SaaS software platform for the automated informational and analytical breakdown of chart screenshots of financial markets uploaded by the user.
1.2. ApexFlow is not a broker, dealer, exchange, trading venue, payment institution or other professional participant in the capital markets. The Service does not accept, hold or withdraw user funds for trading, does not open trading accounts and does not execute trades.
1.3. ApexFlow is not an investment adviser and does not carry out investment advisory, asset-management or trust-management activity. The Service does not hold, and is not required to hold, any capital-markets professional license, since it does not carry out the corresponding activity.
2. Informational nature of the materials
2.1. All materials of the Service — automated analysis results, market phases, scenarios, indicative entry, stop and target levels, the answers of the AI assistant ALBERT, texts and other data — are informational and analytical only.
2.2. The Service's materials are not, and may not be regarded as:
- individual investment advice or investment recommendations;
- an offer or an inducement to buy or sell any financial instruments;
- a guarantee or forecast of returns;
- financial, legal or tax advice.
2.3. Analysis results are generated by algorithms and AI models based on limited data (the uploaded screenshots) and may contain inaccuracies or errors, or may fail to account for material market factors. Historical patterns do not guarantee their repetition in the future.
3. Independence of the User's decisions
3.1. The User makes any trading and investment decisions independently, at their own risk and on their own responsibility, regardless of whether the Service's materials were used.
3.2. Before making decisions, the User should independently assess the market situation, their own financial position, experience and acceptable level of risk, and, where necessary, consult licensed financial advisers.
4. No guarantee of results
4.1. The Provider does not guarantee any profit, the achievement of any trading or financial result, or the accuracy, completeness and applicability of any of the Service's materials to a specific market situation.
4.2. Trading on financial markets (including the FX market, the crypto-asset market and derivatives) involves a high level of risk and may lead to a partial or total loss of invested funds. Do not use funds for trading that you cannot afford to lose.
5. Limitation of liability
5.1. The Provider is not liable for any direct or indirect losses, lost profit or other losses arising from: the use of or inability to use the Service; trading decisions made by the User with the help of the Service's materials; or inaccuracies or errors in automated analysis results.
5.2. In any event, the Provider's aggregate liability is limited in the manner set out in Section 7 of the Public Offer.
6. Acceptance of the terms
By using the Service, the User confirms that they have read this document, understand the risks of trading on financial markets and accept that ApexFlow's materials are an informational and analytical tool, not a guide to action.
